Breakfast Briefing: Duties Owed to Creditors, Impecunious Corporate Litigants and Non-Party Costs Orders

This two part presentation will focus, firstly, on the development of the law surrounding duties owed to creditor in insolvency scenarios in light of the decision of the UK Supreme Court in BTI 2014 LLC v Sequana SA [2022] UKSC 25.

In the second half, there will be a review of the Moorview principles, the joinder of non-parties for the purpose of making costs orders, and recent applications concerning those principles in the context of directors of insolvent companies.
