CIBA Breakfast Briefing: Repossession Law - 28th May 2025

The presentation, chaired by Patricia Hickey, focused on repossession law, featuring speakers Tomas Keys BL, who discussed practice and procedure and Keith Rooney BL, who addressed post-order issues such as substitution, leave to execute, trespass, and injunctions. Recent case law and legal developments were discussed, particularly benefiting younger members appearing before the County Registrars and Circuit Courts nationwide. By the end of the presentation, participants had understood the key elements of possession law, practice and procedure, current case law, and were equipped to advise on the legal positions regarding creditor and borrower options, defenses, and enforcement steps.
